1. Parties
These Terms & Conditions apply to all yacht charter bookings made through:
Heuristica Ltd, trading as SailScanner

(“SailScanner”, “we”, “us”, or “the Agent”)
and the individual or entity making the booking
(“the Charterer” or “the Client”).
2. Role of SailScanner
2.1 SailScanner acts solely as an agent for the yacht charter provider (“the Operator”).
2.2 The binding charter contract for the yacht is formed directly between the Charterer and the Operator once the booking is confirmed.
2.3 SailScanner’s role includes:
- presenting suitable yacht options,
- managing booking communication,
- collecting payments on behalf of the Operator,
- issuing invoices and documentation,
- liaising between the Charterer and the Operator.
2.4 SailScanner is not the owner, operator, or manager of any vessel.
2.5 Responsibility for vessel condition, seaworthiness, crewing, operation, and delivery rests entirely with the Operator.
3. Pricing & Inclusions
3.1 Only items explicitly listed on the SailScanner invoice are included in the charter price.
3.2 Unless otherwise stated on the invoice, prices exclude:
- fuel,
- security deposits,
- tourist or local taxes,
- marina and mooring fees outside the home base,
- food and beverages,
- provisioning,
- transfers,
- skippers or crew,
- optional extras.
3.3 Any discounts applied are reflected on the invoice and do not alter the Operator’s underlying charter terms.
4. Payments
4.1 Payment amounts, schedules, and deadlines are specified on the SailScanner invoice.
4.2 A booking is not confirmed until the required deposit has been received and accepted by the Operator.
4.3 Late or missing payments may result in cancellation under the Operator’s terms.
4.4 All payments collected by SailScanner are taken on behalf of the Operator.
5. Cancellation
5.1 All bookings are subject to the Operator’s cancellation policy, which applies in all cases.
5.2 Unless otherwise stated by the Operator, deposits are non-refundable.
5.3 Cancellations after the balance due date may be subject to up to 100% of the charter fee.
5.4 If the Operator re-charters the yacht for the same period, any refund is calculated and issued at the Operator’s discretion.
5.5 SailScanner does not impose or retain cancellation fees.
6. Amendments & Changes
6.1 Any changes to dates, yachts, crew, or services require Operator approval.
6.2 Price adjustments may apply.
6.3 SailScanner will submit amendment requests but cannot guarantee acceptance.
7. Skipper & Crew Requirements
7.1 Where applicable, the Charterer must provide:
- valid skipper licence(s),
- VHF / radio certificate,
- passport details for all crew,
- completed crew list.
7.2 The Operator has final authority to approve or reject documentation.
7.3 If qualifications are insufficient, the Operator may require a professional skipper at the Charterer’s expense.
8. Security Deposit
8.1 Security deposits are set by the Operator and payable directly at base unless stated otherwise.
8.2 Security deposits cover damage, loss, or penalties incurred during the charter.
8.3 SailScanner does not collect or manage security deposits.
9. Insurance
9.1 The Operator provides hull and third-party liability insurance for the vessel.
9.2 The Charterer is responsible for arranging appropriate:
- travel insurance,
- cancellation insurance,
- medical insurance,
- skipper liability insurance (if applicable).
10. Liability
10.1 SailScanner acts solely as an intermediary between the Charterer and the Operator.
10.2 SailScanner shall not be liable for:
- vessel defects or breakdowns,
- weather conditions or itinerary changes,
- loss of personal belongings,
- delays, force majeure, or Operator non-performance,
- injury, illness, or accidents occurring on board.
10.3 All operational responsibility lies with the Operator.
11. Governing Law
These Terms & Conditions are governed by the laws of England & Wales.
The courts of England & Wales shall have exclusive jurisdiction.
12. Acceptance
By making any payment toward a booking, the Charterer confirms acceptance of:
- these SailScanner Booking Terms & Conditions, and
- the Operator’s General Charter Terms & Conditions.
In the event of conflict, the Operator’s Terms take precedence for all operational matters.
